PLEASE NOTE THAT THIS PROMOTIONAL COMPETITION IS CO-PROMOTED BY BK Marketing Fund (Pty) Ltd (“Burger King”) AND MR DELIVERY (PTY) LTD (“Mr D”).
The following terms and conditions apply exclusively to the aforementioned Competition:
1. Co-promoters
This Promotional Competition (“Competition”) is co-promoted by Burger Kind and Mr D (collectively the “Promoters”). Each Party shall be solely responsible for the administration of their respective roles in respect of the Promotional Competition and warrants that in so doing, it shall comply with all applicable provisions of the Consumer Protection Act, 68 of 2008, as amended (“CPA”).
2. Competition Period
The Competition shall commence at 08h00 (South African time) on 21 November 2022 and end at 22h00 (South African time) on 31 December 2022 (the “Competition Period”).
3. Who Can Enter:
3.1. The Competition is open to: (i) natural persons who are at least 18 years old residing in South Africa and who are in possession of a valid form of identification (South African Identity Document or Passport); (ii) who have a valid Mr D account; and (iii) it being lawful for such persons to be awarded the particular prize. Persons ARE NOT ALLOWED to participate in this Competition if they are a minor, employee, director, member, partner, agent or consultant of the Promoters, or any person who directly or indirectly controls or is controlled by either Promoter and/or immediate family members of any of the above persons, its advertising agencies, advisers, dealers, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to Burger King, its affiliates and/or associated companies.
3.2. By entering the Competition, all participants and the winners agree to be bound by these terms and conditions. The Promoters reserve the right at any time, without notice, to amend, modify, or change these terms and conditions and any prizes, and to postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason which is beyond the Promoters’ reasonable control.
3.3. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time the prizes are awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement winner shall take place under the same terms and conditions as the first draw.
4. The Prize:
4.1. Participants stand a chance to win a hamper that includes one of the following: a R500 (five-hundred rand) Mr D coupon AND a PS5 game – Call of Duty: Modern Ware II to the value of R1599, as well as a R500 (five-hundred rand) Mr D WiCode coupon. There will be only 1 (one) weekly winner of the Prize as described above. There will be a total of 5 (five) winners for the duration of the competition.
4.2. The Prize is not transferable and may not be exchanged or sold for cash or any other item.
5. How To Enter:
5.1. To enter a person must, during the Competition Period, log onto Twitter AND tweet their reply to the Burger King® & Mr D Call of Duty questions of the day which will be posted on the Mr D Twitter profile using ALL of the following hashtags #COD #BURGERKING #BKCOD #MRD #GAMERS ("Qualifying Entry”).
5.2. Participants may enter the Competition subject to the following:
a. All entries must be made by a natural person on Twitter.
b. If any entry was made in a manner which provides the participant with an unfair advantage over other entrants, such a participant will be disqualified from this Competition.
c. Participants may enter this Competition as many times as they like provided they complete the entry mechanics set out above each time. However, participants are only eligible to stand a chance to win 1 (one) Prize under this Competition.
6. Winners
6.1. Mr D will run an audited draw from the Qualifying Entries submitted during the Competition Period to select the winners who have taken the steps set out in section 5 above and who are in compliance with these terms and conditions. The Prize winners will be announced via the Mr D Twitter Social Media page via Twitter Direct messaging at the end of the week. Mr D will contact the winner via Direct Messaging on the winners Twitter Social Media account to request the winner’s name, surname, email address, ID number and telephone number
(“Participant Information’’). Mr D will make two direct attempts to obtain such information. Once this information is received and validated, representatives of Mr D will deliver the coupon component of the Prize via a Direct Message on the winners Twitter Social Media account, once the Participant Data has been verified, subject to section 8 below. In order to receive the Prize, participants must ensure that their Twitter Direct messaging is activated and respond to initial contact for information within 3 days. Proof of identity may be required in order to validate the winner. The Promoters’ decision is final and no correspondence will be entered into regarding the application of these terms and conditions, the selection of a winner, and the Prize.
6.2. Mr D will further request consent from the winner to share the Participation Information with the third-party contractors it engages to manage the execution of its obligations in terms of this Competition, for delivery of the other components of the Prize.
6.3. Once the winner has been verified and the winner has provided their/his/her consent for Mr D to provide their/his/her Participation Information for delivery of the Prize, Mr D will then communicate with the winner via email and or Twitter direct message regarding when, where (i.e. within the Republic of South Africa) and how they will receive their Prize. The winner will receive their Prize within 14 (fourteen) working days from being notified by Mr D as per paragraph 6.2 above.
6.4. Once the winner has received the Prize, the Promoters will not take responsibility for any malfunction or defect in the Prize. Ownership of and risk in and benefit attached to the Prize will pass on to the winner immediately.
7. Disqualification of Winner:
If either Promoter (or their agents) (as the case may be) is unable to reach a winner after 48 (forty eight) hours from the date of the winner being notified that they have won the prize, or if a winner fails the verification process after drawing his/her entry, or does not consent to the sharing of their Participation Information to effect delivery of the Prize for whatsoever reason, such person will be disqualified and a draw for a replacement entry and winner will take place.
8. Use of Participant and Winner Information
8.1. All participants and the winner, as the case may be, indemnify the Promoters, their advertising agencies, affiliates, advisers, nominated agents, partners, suppliers and bottlers of beverages identified by the trademarks owned by or licensed to the Promoters, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or receipt of the Prize and/or use of the Prize).
8.2. The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and television or social media, when accepting a Prize or after having received a Prize, but a winner will be entitled to decline to do so.
8.3. By entering the Competition, the participants agree that their personal information may be shared with the Promoters, and third-party service providers engaged by the Promoters for the execution of compliance with the CPA requirements and to effect the delivery of the Prize. Such personal information will be used only to the extent that it is necessary for administering this Competition and in accordance with the provisions of the Protection of Personal Information Act, 4 of 2013, as amended (“POPI Act”) and Mr D’sprivacy policy found at [https://www.mrdfood.com/privacy-policy].
8.4. The Promoters may require a winner to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these terms and conditions as well as the CPA . Should any winner refuse or be unable to comply with this clause for any reason, such a winner will be deemed to have rejected the Prize and Mr D will be entitled in its sole discretion to select another winner from amongst the qualifying entries submitted.
8.5. By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, participants consent and give the Promoters a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a participant on a social media platform, for the purposes of promoting the products and services of the Promoters.
9. Unforeseen events
In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the Promoters reserve the right to cancel this Competition (before entries are received), to change the number or nature of the prize at any time (on notice to you), or to change the rules at the Promoters’ discretion (provided that the Promoters will not change the conditions for participation or conditions for being awarded the prize, as stated herein).
