Terms and Conditions Governing Participation in the Johnnie Walker Flavourcation Competition 

PLEASE NOTE THAT THIS PROMOTIONAL COMPETITION IS CO-PROMOTED BY DIAGEO (PTY)  LTD (“DIAGO”) AND MR DELIVERY (PTY) LTD (“Mr D Food”). MR D FOOD WILL BE RESPONSIBLE  FOR RUNNING THE AUDITED DRAW, SELECTING WINNERS FOR THE PRIZE(S) DETAILED  BELOW. MR D FOOD IS RESPONSIBLE OF SHARING THE SELECTED WINNERS DETAILS WITH  DIAGO ONCE THE CUSTOMERS HAVE GIVEN CONSENT TO DO SO. DIAGO WILL BE  RESPONSIBLE FOR COMMUNICATING WITH THE SELECTED WINNERS PRIOR TO DELIVERY OF THE PRIZE.

PRIZES AND OBTAINING EACH PARTICULAR WINNER’S CONSENT FOR PURPOSES OF  DELIVERY OF HIS/HER CORRESPONDING PRIZE ACCORDINGLY. 

The following terms and conditions apply exclusively to the aforementioned Competition: 

1. Co-promoters 

This Promotional Competition (“Competition”) is co-promoted by Diago and Mr D Food (collectively  the “Promoters”). 

2. Competition Period 

This competition runs from 08h00 on 9 December 2022 until 23h59 on 16 December 2022  (“Competition Period”). No entries will be accepted after 23h59 on 16 December 2022.  

3. Who Can Enter 

3.1. The Competition is open to: (i) natural persons who are at least 18 years old residing in South  Africa and who are in possession of a valid form of identification (South African Identity  Document or Passport); (ii) who have a valid Mr D Food account; and (iii) it being lawful for such  persons to be awarded the particular prize. Persons ARE NOT ALLOWED to participate in this  Competition if they are a minor, employee, director, member, partner, agent or consultant of the  Promoters, or any person who directly or indirectly controls or is controlled by either Promoter  and/or immediate family members of any of the above persons, its advertising agencies,  advisers, dealers, suppliers identified by the trademarks owned by or licensed to Mr D Food, its  affiliates and/or associated companies or any persons who have won a prize in a competition  run by Mr D Food in the past 6 (six) months.  

3.2. By entering the Competition, all participants and the winners agree to be bound by these terms  and conditions. The Promoters reserve the right at any time, without notice, to amend, modify,  or change these rules and any prizes, and to postpone, suspend or cancel this Competition and  any prizes, or any aspect thereof, without notice at any time, for any reason which is beyond  the Promoters’ reasonable control. 

3.3. The Competition is only valid within South Africa. Participants must be within South Africa  at the time of entering the Competition, for the verification process and at the time the prizes  are awarded should they be declared a winner, failing which such person will be disqualified  and the draw of a replacement entry shall take place under the same terms and conditions as  the first draw.  

4. The Prizes 

4.1. The participants stand a chance to win one (1) of (25) Double Tickets to Flavourcation (the  “Prize”). when ordering a bottle of Johnnie Walker  

4.2. Diageo SA will not be responsible for any other expenses which the winner may incur as a result  of their acceptance of the prize, whether foreseen or not. Travel costs and accommodation Any  costs or expenses incurred in respect of items not specifically included in the prize for the  winner’s own account. Diageo SA and its associates, if applicable, are not included in the prize. 

4.3. The prizes under this Competition are not transferable and may not be exchanged for cash or  any other item. Diageo SA reserves the right to alter the prize for a prize of comparable  commercial value.

4.5. In order to receive the Prize, participants must ensure that they share consent with Mr D to  share their contact details.  

5. How To Enter 

5.1. To enter this Competition, participants add a bottle of Johnnie walker to their order and stand a  chance to win.

6. Winners 

6.1. The winners will be chosen by way of random draw, at or before 16 December 2022. The winners will be announced by way of direct message to his/her Mr D Food login email address after the  campaign period. We will then send a direct message via the particular winner’s Mr D Food login  email address to request his/her name, surname, email address, ID number, delivery address and  telephone number (“Participant Information”). We will make two direct attempts to obtain such  information. Once we have received this information and validated the particular winner, we will  deliver the Prizes to the winner's address to him/her as soon as possible, subject to section 10  below. Proof of identity will be required in order to validate the particular winner. We will select a  winner who has taken the steps set out in section 4 above and who is in compliance with these rules  by way of random draw, at our sole discretion. Regarding the application of these rules and the  selection of a winner and his/her prize in terms hereof, our decision is final and no correspondence  will be entered into with a competition participant other than the particular winner. 

6.2. Once the winner has received the prize, the Promoters will not take responsibility for any product  malfunction or defect. Ownership of and risk in and benefit attached to the prize will pass on to  the winner immediately. 

6.3. A winner is obligated to behave responsibly and comply with these terms and conditions  and all reasonable requests of the Promoters and their agents.  

7. Disqualification Of Winner 

There are certain situations in which a winner will be disqualified from receipt of his/her Prize,  namely: (i) he/ she did not activate the direct messaging function on their Facebook or Twitter  account (ii) he/she fails to provide Participant Information when requested by Mr D Food for the  second time; (iii) he/she is found to have contravened any other rule set out herein; (iv) in  anticipation of delivery of the prize, he/she refuses to or cannot provide reasonably sufficient  documentation to verify his/her identity; or (v) he/ she does not consent to the sharing of their  Participant Information with Mr D Food or their agents, to effect their obligations in terms of  this Competition. In the event of disqualification of a particular winner, Mr D Food will be entitled in  its sole discretion to select another winner from amongst the qualifying entries submitted. 

8. Use of Participant and Winner Information 

8.1. All participants and the winners, as the case may be, indemnify the Promoters, their advertising  agencies, advisers, nominated agents, partners, suppliers and Bottlers of beverages identified  by the trademarks owned by or license 

8.2. The Promoters may require the winners to be identified, photographed and published in printed  media, or to appear on radio and television, when accepting their prizes or after having received  their prizes, but each winner will be entitled to decline to do so. 

8.3. By entering the Competition, the participants agree that their personal information may be  shared between the Promoters, and third-party service providers engaged by the Promoters for  the execution of compliance with the Consumer Protection Act requirements and to affect the  delivery of the Prize. Such personal information will be used only to the extent that it is  necessary for administering this Competition and in accordance with the provisions of the  Protection of Personal Information Act, 4 of 2013 (“POPI Act”) and Mr D Food’s privacy policy  found at [insert].  

8.4. The Promoters may require a winner to complete and submit an information disclosure  agreement and indemnification to enable the Promoters to ensure compliance with these terms  and conditions as well as the Consumer Protection Act 68 of 2008. Should any winner refuse  or be unable to comply with this clause for any reason, such a winner will be deemed to have  rejected the prize and Mr D Food will be entitled in its sole discretion to select another winner  from amongst the Qualifying Entries submitted. 

8.5. By posting any content, experiences, images on any social media platform, in relation to this  Competition and its associated promotional activities, participants consent and give the  Promoters a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt  and publish any content posted and/or submitted by a participant on a social media platform,  for the purposes of promoting the products and services of the Promoters. 

9. Unforeseen events 

In the event of unforeseen circumstances or causes beyond the Promoters’ reasonable control, the  Promoters reserve the right to cancel this Competition (before entries are received), to change the  number or nature of the prize at any time (on notice to you), or to change the rules at our discretion  (provided that we will not change the conditions for participation or conditions for being awarded the  prize, as stated herein).
