TERMS AND CONDITIONS

 

1.     This YES TO FRESH EXPERIENCES 2025 campaign (“Campaign”) is organized by PVM South Africa with registered office in 2 Country Club Est, Woodlands Dr, Woodmead, Johannesburg, 2052 (“Organizer”).

 

2.     This Campaign begins on 1 June 2025 at 00:01am and ends on 31 August 2025 at 11:59pm (“Entry Period”). To be eligible for the Campaign  entries must be received within the specified Entry Period. No entries outside of the campaign period will be accepted.

 

3.     Products: The participating products that enter this Campaign are listed below: (“Products”)

4.     Eligibility: The Campaign is open only to those who sign up/enter into participation and who are 18 years of age or older] as of their date of entry

 

5.     “Participant(s)” are required to purchase any 2 (two) of the above mentioned Mentos products, in a single valid transaction at any participating store/s in the Republic of South Africa during the competition period/s. To enter the competition, “Participant(s)” can scan the QR code on campaign print collateral in stores or digital assets online OR dial the competition whatsapp number (+21 82 476 3149), follow the easy prompts, including uploading a clear copy of their till-slip to quality.

 

6.     Organizer acknowledges that this Campaign is in no way sponsored, endorsed, or administered by, or associated with Instagram/Facebook/TikTok, WhatsApp and releases Instagram/Facebook/TikTok, Whatsapp of any and all liability in relation to this Campaign. Any information provided by the Participant under this Campaign is provided to the Organizer and not to Instagram/Facebook /TikTok, WhatsApp. In accepting these terms and conditions Participants release Instagram/Facebook /TikTok, WhatsApp from any liability to the fullest extent possible in law. 

 

7.     Organizer's employees, or employees of its affiliates, suppliers, partners, advertising and promotion agencies (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Campaign.

 

8.     Territory: This Campaign is only valid in the Territory of Republic of South Africa.

 

9.     Points of sale: This Campaign is valid in all points of sale located in the Territory where the Products in Campaign are available and in stock.

 

10.  Purchase of Product After purchasing the Product, Participants must keep the purchase receipt.

 

11.  Agreement to Terms and Conditions/Rules: By entering this Campaign the Participant accepts and agrees to abide by this Terms and Conditions and Organizer’s decisions, which are fully and unconditionally binding in all respects. The Organizer reserves the right to refuse, withdraw, or disqualify any entry at any time at the Organizer’s sole discretion. By entering this Campaign the Participant represents and warrants to be eligible to participate based on eligibility requirements explained in this rules. The Participant also agrees to accept the decisions of the Organizer as final and binding as it relates to the content of this Campaign.

 

12.  How to Enter:

12.1.      To participate, purchase any two (2) or more packs of Mentos Gum, Candy, or Incredible Chews from any participating retailer nationwide. Participating retailers include, but are not limited to: Shoprite, Checkers, Checkers Hyper, Pick n Pay, Spar, Clicks, Dis-Chem, Engen, Caltex, BP, Sasol, and Makro.

12.2.      This offer is subject to availability of promotional stock at the time of purchase.

12.3.      Enter by scanning the QR code on Point of Sale or send “Fresh” to the WhatsApp line, 082 476 3149

12.4.      Participants must follow the prompts, upload a till slip and complete the entry user journey to be considered for the weekly and grand prizes

12.5.      Network charges may apply.

 

13.  Prizes include:

13.1.       Grand Prizes: include 1 of 3 R50 000 to put towards an local travel experience. The draw will take place at the end of the entry period

14.  The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Organizer. There shall be no cash or other prize substitution permitted except at the Organizer’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all applicable taxes. The Winner shall not assign of the prize to others nor shall the Winner request the cash equivalent or prize substitution.Vouchers are subject to suppliers’ terms and conditions and expiry dates.

 

15.  Winners selection: The winners will be selected by random draws  by the Organizer as set out hereunder in the table below:

 

15.1. Draw Dates  are subject to change at the discretion of the organiser for reasons such as but not solely limited to operation needs, technical issues and/or insufficient entries

16.  Winners notification: The Organizer will notify the Weekly winner(s) by SMS the week after the prizes are drawn

 

17.  Grand prize winners will be contacted by Phone within 14 (FOURTEEN) working days following winner selection and will be required to submit valid lawful documents and information such as copies of identity documents or proof of address not older than 3 monhs that includes full name, home address, an active phone/mobile number, and a verified copy of their personal identity document.

 

18.  In case the Participant is younger than 18 years old, the Organizer will request the Winner to provide the written parental authorization.

 

19.  If the winners cannot be contacted or not provide any confirmation within 3 (THREE) days to the Organizer after having been informed, such Winner will be considered void without notification and the Prizes will be transferred to other Participants who fits the winner qualifications/or were selected as substitutes.

 

20.  The Organizer is not responsible for nor shall have no liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam email. Nor shall be Organizer liable for the winner’s provision of incorrect or otherwise non-functioning contact information.

 

21.  If the winner 1) fails to claim the prize within 30 (THIRTY) days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an substitute winner may be selected.

 

22.  Receipt of the prize by the winner is upon the condition of compliance with this terms and conditions and any and all applicable laws and regulations.

 

23.  Delivery of the prizes:

23.1. Prizes will be delivered by the Organizer (directly or through the agency or expedition company appointed by the Organizer for that purpose), to the address of the winners according to the information provided by the Participant to the Organizer following this terms and conditions. The Organizer will not be responsible for any error in the delivery if it is due to the winners’ mistake.

 

23.2. Weekly prizes will be delivered by Cash Send (cash vouchers) and digital vouchers on SMS

 

23.3. Grand Prize will be given a specified travel agent to plan and book their “experience”

 

24.  Photos upload: The Participant represents and warrants that (i) it is the creator/producer of the photo] uploaded and that all necessary permissions, including from any identifiable individuals featured in the photo, for its lawful use in this campaign. The participant indemnifies the Promoter against any third-party claims arising from unauthorised use of such content to have right to upload it in the Campaign for the purposes of participation (ii) the uploaded photos do not contain content of race, religion, lewd, slander, etc. that would violate any regulation or law, (iii) the uploading of the photo following this Terms and Conditions is made under the Participant’s sole responsibility being the Organizer expressly exonerated from any liability for infringement or breach of rights which may arise from the upload and in particular, with regard to possible violations of the rights of third parties (image, intimacy, honor, intellectual property and/or any other that might exist). Consequently, the Participant expressly exempts and leave the Organizer harmless from any liability and/or damage that may arise from the uploading and use of the photo as well as from its use by any third party.

 

25.  The Participant grants the Organiser the right to use their uploaded photo(s), profile name, and the likeness of any individuals appearing in the photo(s), as well as any other content submitted as part of the Campaign, for purposes related to the Competition, including marketing and promotional use across print, digital, and social media platforms. No compensation will be payable for such use. Participants will be given the opportunity to decline publication of their image or participation in promotional materials.

 

26.  Personal Data Protection: In compliance with the applicable personal data protection laws, the Organizer informs the Participants that the personal data provided to participate in the Campaign will be collected and processed under the control of the Organizer solely for the purpose of operating this Campaign including the management of the Participant’s participation and, in its case, the delivery of the Prize and the publication of the Participant’s data as winner of a a prize as indicated in this Terms and Conditions. Consequently, the processing of the Participant’s personal data is based on the Participant’s will to participate in the Campaign.

 

27.  The personal data processed will be kept as long as the Campaign is in force and after only for the publication purposes referred and/or as long as it is necessary to comply with any legal regulation that may impose the Organizer the obligation to keep the data for a longer period of time.

 

28.  The Organizer informs the Participant, that accepts, that it may outsource to third parties  part of the services related to the management of the Campaign with the purpose to obtaining logistic and/or administrative support (for instance, companies that carry out the service of delivering the prizes, or companies rendering technological services like hosting of the Organizer’s Website or social media channels). All these companies are acting as processors or authorized recipients and can have access to and/or process the Participant’s personal data only as far as it is necessary to comply with the purposes of this Campaign.

 

29.  The Organizer informs the Participant that he/she has right to request access to and rectification or erasure of his/her personal data, or restriction or objection to processing, as well as the right to data portability or to withdraw the consent given by addressing to the Organizer  by sending an email to support1@hcdigital.co.za, always providing a copy of the identification document or any other document proving it.

 

30.  Organizer reserves the right to verify the truthfulness of the personal data provided by the Participant at any time.

 

31.  Organizer's decision on the winner cannot be contested.

33.  Campaign advertising: The advertising of this campaign will be made on point of sale and/or in other supports that the Organizer deems appropriate.

 

34.  Use of an automated system to participate is prohibited and will result in disqualification. The Organizer has the right, at its absolute discretion, to disqualify the winner if the Participant's acts to participate or information provided does not comply with the rules and regulations of the competition. The Organizer shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims and entries including, without limitation, to require further verification as to the identity, age and other relevant details of a Participant and before accepting a claim or entry as being valid.

 

35.  The Organizer reserves the rights to vary these Terms and Conditions or cancel the Campaign at any stage in the event of circumstances arising beyond its control. Any change shall be advertised in the same way this Campaign has been advertised.

 

36.  In its sole discretion, the Organizer reserves the right to modify, suspend, cancel, or terminate the Campaign should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Organizer’s control, impact or corrupt the security, fairness, proper conduct, or administration of Campaign. The Organizer, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Organizer. Individuals who tamper with or attempt to tamper with the operation or entry process of the Campaign or website or violates these Terms & Conditions will be disqualified by the Organizer in its sole discretion. In its sole discretion, the Organizer has the right to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: [identify any disallowed entry methods that will result in votes/entries being voided; examples: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the Campaign  rules; or the use of bots, macros, scripts, or other technical means for entering.] Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. If any such attempt is made, the Organizer reserves the right to seek damages to the fullest extent permitted by law.

 

37.  Limitation of Liability: Entry into this Campaign constitutes Participant’s agreement to release and hold harmless the Organizer and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Campaign and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

 

42. Other conditions and considerations

42.1. Entries will be considered by the order in which they were submitted via Whtand their validation.

 

42.2. Organizer will not be responsible for any problem that occurs with the Internet connection used to send entries.

 

42.3. Organizer will not be responsible for any stock breakage in the affiliated points of sale.

 

43.  Applicable law: This Campaign is governed by the laws of Republic of South Africa
